COURSE FEE
A fee in the amount of $44.95 will be charged to the student. This fee needs to be paid prior to course completion and certificate delivery. There shall be no hidden fees and fees shall not change after the student registers for the course and accepts these terms and conditions.

COURSE SCHEDULE
EMPIRE SAFETY COUNCIL (hereafter referred to as "ESC"), offers a course consisting of 11 sessions of instruction. The course is available 24 hours a day, 7 days a week. This availability may be affected by circumstances such as, but not limited to, system, site or connectivity failure over which ESC has no control. The minimum time allowed by law to complete this course is 320 minutes. The course must be completed within 30 days of registration as per New York State DMV requirement.

ELIGIBILITY
In compliance with New York State Vehicle and Traffic Law Section 215(a), 399-1and 399-n and Section 2336 of the Insurance Law, licensed New York motorists may complete an Internet Point and Insurance Reduction Program (iPIRP). Upon completing this course and if you are the principal operator of a motor vehicle, you will receive a minimum 10% reduction in the base rate of your automobile and motorcycle liability and collision insurance premiums each year for three years. You may be eligible to reduce as many as four (4) points on your driving record. The DMV computer will automatically note your eligibility to receive the reduction.

SYSTEM REQUIREMENTS
There are NO special system requirements or downloads necessary to take this on-line course. Students will need to have JavaScript enabled on their Internet browser to view some of the features in the course. Most browsers (like Internet Explorer, AOL, Netscape, Firefox, etc.) are JavaScript enabled by default - meaning these features should function unless you, the student, have manually disabled JavaScript in your Internet browser's settings/options.

COMPLETION AND CERTIFICATE POLICY
The STUDENT agrees to complete all sessions, quizzes, and the final exam of the course in order to receive a certificate of completion. ESC is prohibited from issuing a certificate of completion if the student has not met all the requirements for course completion. As an Internet course provider, ESC will issue you a completion certificate within fourteen (14) business days after you complete the course.

AUTHENTICATION/VALIDATION
ESC shall include a biometric "Phone Contact with Caller ID" identity validation method delivered securely via patent pending technology provided by CompletelyOnline®. During the course the student will be prompted to call our 24-hour toll free number seven (7) times randomly to verify his/her identity. The student is required to call each time to the toll free number from the same phone number provided at initial registration - calling from any other number will be considered an incorrect answer - and result in a failed validation attempt. When the student is prompted to call in, he/she will only have 40 seconds to do so. Therefore, it is extremely important that the student have his/her telephone available at all times while taking our course. Failure to call in within the 40 seconds will be considered an incorrect answer. The student will register his/her ten (10) digit phone number - including area code. Remember: the student must always call in from this same registered phone number. ESC shall also include a personal validation questionnaire to be completed at the beginning of the course. The student will be required to correctly answer personal validation responses throughout the course in order to further validate the personal identity of the student. Two failed attempts to verify the student's identity (either through the Phone Contact with Caller ID method or Personal Validation response) will result in course failure and the course fee may not be refunded. Per the NY DMV regulations, the student's biometric data will be retained for 5 business days after course completion. The student is also required to complete the course content/environment quizzes to be presented at the end of each session. The user will have 60 seconds to correctly answer each question. STUDENT AFFIRMATION
The student agrees that he/she, and not any other person, will study the material in its entirety, and complete the end of session quizzes and final exam. It is illegal to attempt to circumvent this online state-approved course or provide false information. If ESC discovers that the STUDENT has willfully misrepresented himself or has cheated, the student will be stopped from taking the course with no refund of the registration fees. In addition, the student may be prosecuted for perjury, or other criminal acts which are punishable by law.

CANCELLATION AND REFUND POLICIES
A full refund will be made to any student who cancels the enrollment contract within 30 days of registering for the course and prior to completing the final exam. ESC will terminate, without notice, the enrollment of any student who has not successfully completed the course within 30 days. All registration fees paid are due and refundable when the course of instruction is discontinued by ESC, thus preventing a student from completing the course. All refunds will be issued within 30 days following cancellation.

POINT REDUCTION
As an Internet course provider, ESC will notify the DMV within thirty (30) business days after you complete the course. A notice will then be entered on your driving record, and the DMV computer will automatically reduce your active point total by up to four points. Important: Completion of a course under the "Point & Insurance Reduction Program" does not remove, delete, subtract, or erase any violation, conviction, or notice of original number of points from your driving record. Even after you complete the course, most violations, conviction and points assessed will continue to show on your driving record for up to four years. Violations and convictions involving drugs or alcohol will remain on your driving record for ten years. "Point reduction" means the DMV will not count up to four points on your driving record toward license revocation or suspension. If you need to verify the course completion has been entered on your record, you may request a copy of your driving record from the DMV.

POINT REDUCTION (Continued..)
Point reduction applies only to points assessed for violations that occurred within the eighteen months immediately before course completion. It does not affect points for earlier violations, and cannot be used as "credit" against future violations or points. Point reduction cannot reduce your point total lower than zero. If your license has already been revoked or suspended, or if a violation hearing has already been scheduled, point reduction will not affect that action. Point reduction does not prevent or cancel a mandatory revocation or suspension for violations such as DWI, DWAI, or three speeding violations within 18 months. Points may be reduced only once in any 18-month period. The DMV point system and insurance company "point" systems are separate and not related. Point reduction on your driving record does not affect points assigned by your insurance company for violations and accidents. Completion of a course under the "Point & Insurance Reduction Program" also cannot prevent or reduce the calculation of points affecting a "Driver Responsibility Assessment."

INSURANCE REDUCTION
As an Internet course provider, ESC will issue you a completion certificate within fourteen (14) business days after you complete the course. If you present your certificate to your insurance company or agent within 90 days after course completion, your liability and collision premium reduction will begin immediately, retroactive to the date you completed the course. If you present your certificate more than 90 days after course completion, the insurer may issue the premium discount effective from the date presented. You may take the course once every 36 months to maintain insurance reduction benefits. Insurance reduction does not prevent general premium increases, or premium increases due to violations or accidents. It provides a 10% reduction for three years, from the base rate of your current liability, no-fault and collision premiums.
